Test Drive Terms and Conditions

Whereas the Customer is interested in acquiring a vehicle from the Retailer and has requested the opportunity to drive the Demonstrator Vehicle (the "Vehicle") for a short period of time.

Wherefore the Customer covenants and agrees with the Retailer as follows:

1. The Retailer consents to the Customer operating the Vehicle for a period of time not to exceed the date and time set out above (the "Test Period") for the purpose of testing the Vehicle before making a decision whether or not to buy, lease, or otherwise acquire an interest in the Vehicle.
2. The Customer agrees to return the Vehicle to the Retailer before the expiry of the Test Period in the same condition in which the Customer acquired it, and to use the Vehicle only for the purpose of reasonably testing the Vehicle before making a decision whether or not to buy, lease, or otherwise acquire an interest in the Vehicle.
3. During the Test Period, the Customer shall be entirely responsible for the Vehicle notwithstanding any other provision of this Agreement, and without limiting the foregoing, shall maintain the Vehicle and indemnify the Retailer for any loss or damage to the Vehicle.
4. Notwithstanding any other provision contained herein, the Retailer, at its sole and arbitrary discretion, may require immediate payment of the amount of any loss or damage to the Vehicle or costs, charges, or expenses arising out of its use, and the Customer agrees to pay such amounts.
5. As security for the performance of its obligations herein:
   1. The Customer pledges the Customer's vehicle or the Customer's interest therein.
   2. The Customer authorizes the Retailer to charge to the Customer's credit card any and all costs, amounts, and charges incurred by the Customer herein.
6. The Customer shall be solely responsible for any traffic violations, toll fees, parking tickets, fines, penalties, forfeitures, court costs, and legal costs incurred.
7. The Customer shall not lend the Vehicle to any person without first obtaining the written consent of the Retailer.
8. The Customer shall not have any ownership rights to the Vehicle by reason of this Agreement.
